Acceptable Use Policy

This Acceptable Use Policy (the "AUP") forms part of the Realytics Terms of Service and the Realytics US Enterprise Terms of Service (each, the "Agreement"). Capitalized terms not defined here have the meanings given in the Agreement.

Realytics may suspend or terminate access under the Agreement where it reasonably believes this AUP has been breached or where action is necessary to protect the Service, Realytics, customers, third parties or the public.

1. Lawful and Authorized Use

You may use the Service only for lawful business purposes and only as permitted by the Agreement, Documentation and applicable Order Form.

You must not use the Service or Realytics Output:

(a) in violation of any applicable law, regulation, sanctions, export control, court order or binding platform rule;

(b) to infringe or misappropriate intellectual property, privacy, publicity, database, contract, confidentiality or other rights;

(c) to process data that you have no right to provide to Realytics;

(d) to misrepresent your identity, authority, affiliation, billing location, tax status or business capacity; or

(e) in a way that exposes Realytics to regulatory, civil, criminal, platform or contractual liability.

2. Prohibited Data and Content

Unless the Documentation expressly permits it and Realytics has agreed any additional required terms, you must not submit, upload, connect or process:

(a) special-category data, health data, biometric data, genetic data, children's data, precise geolocation of individuals, payment card numbers, bank credentials, government identifiers or criminal-offence data;

(b) passwords, private keys, access tokens or credentials, except through designated secure credential flows;

(c) malware, exploit code, harmful scripts, corrupted files or content intended to disrupt or compromise systems;

(d) confidential information, personal data or platform data that you are not authorized to provide to Realytics;

(e) data obtained by scraping, crawling, purchasing, licensing or receiving from a third party in breach of law, contract, robots.txt, technical restrictions or a rights-holder reservation; or

(f) content that is unlawful, defamatory, discriminatory, harassing, threatening, abusive, deceptive or designed to facilitate harm.

3. Security and Integrity

You must not:

(a) access or attempt to access accounts, systems, networks, data, APIs or endpoints without authorization;

(b) bypass, disable, impair or probe any authentication, access control, quota, rate limit, monitoring, watermark, attribution, logging or security mechanism;

(c) conduct penetration testing, vulnerability scanning, load testing, denial-of-service testing or similar assessments without Realytics' prior written approval;

(d) introduce malware, spyware, ransomware, bots, credential-harvesting tools or harmful code;

(e) interfere with the operation, integrity, availability or security of the Service or any third-party system; or

(f) use the Service to send spam, phishing messages or unsolicited communications.

Security researchers should report suspected vulnerabilities to and must not access, modify, exfiltrate or disclose customer data.

4. Scraping, Extraction and Competitive Misuse

You must not scrape, crawl, spider, harvest, index, bulk export, systematically query, benchmark or otherwise extract Realytics Output or Service data except through functionality expressly made available in the Service and within the limits of your plan.

You must not use the Service or Realytics Output to build, train, benchmark, improve, operate or support a competing or substitute product, dataset, index, model, benchmark, database, report service or analytics service.

You must not remove, obscure or alter attribution, source labels, watermarks, proprietary notices or usage restrictions.

5. AI, Machine Learning and Text and Data Mining

You must not provide Realytics Output to any large language model, generative AI system, machine learning model, neural network, embedding system, search index, retrieval system or other automated system for training, fine-tuning, grounding, indexing, retrieval-augmented generation, benchmarking, evaluation, prompting, inference or similar use, except where Realytics has expressly authorized that use in writing.

Realytics reserves all rights in Realytics Output, the Service, the Documentation and its websites for text and data mining, AI training, machine learning, scraping, indexing and similar uses, including under Article 4(3) of Directive (EU) 2019/790 and equivalent laws.

You must not use AI features of the Service:

(a) to make decisions about employment, credit, insurance, housing, essential services, healthcare, education, criminal justice, immigration, public benefits or any other decision that produces legal or similarly significant effects concerning an individual;

(b) to generate legal, financial, tax, medical or other regulated professional advice;

(c) to impersonate a person, mislead recipients about whether content is AI-generated, or remove AI-generated-content labels;

(d) to create or distribute deceptive, defamatory, infringing, manipulative or unlawful content; or

(e) in a manner that would cause Realytics to be treated as the provider of a high-risk AI system unless Realytics has expressly agreed that use case in writing.

6. Platform and Third-Party Account Rules

Where you connect or use data from a third-party platform, you must comply with that platform's terms, developer policies, API limits, attribution requirements and privacy rules.

You must not use Realytics to circumvent a third-party platform's access controls, rate limits, paywalls, robots.txt, user consents, opt-outs, contractual restrictions or data-use restrictions.

If a third-party platform instructs Realytics to suspend access, delete data, restrict a use case or disconnect an integration, Realytics may comply without liability to you.

7. Client Deliverables and Publication

Where the Agreement permits you to include Realytics Output in reports, dashboards or deliverables for your own clients, you must:

(a) include appropriate attribution to Realytics;

(b) identify estimates, modeled metrics and AI-generated content as such;

(c) avoid presenting Realytics Output as verified fact, professional advice, or Realytics' endorsement of your recommendation;

(d) include disclaimers substantially equivalent to the reliance and human-review provisions in the Agreement; and

(e) remain responsible for your own advice, recommendations, publications and decisions.

8. Enforcement

Realytics may investigate suspected violations of this AUP. You must cooperate with reasonable investigations, including by providing information needed to verify your identity, authority, connected-account permissions, source of data and compliance with usage restrictions.

Realytics may suspend or terminate access, disable credentials or API keys, block networks or devices, withhold refunds, remove content, require deletion of unlawfully used Realytics Output, and seek injunctive relief where it reasonably believes this AUP or the Agreement has been breached.

Realytics may update this AUP in accordance with the amendment provisions of the Agreement.
